Minutes of the Zoning Board of Appeals meeting held in the Town Hall, lower level meeting-room, 11 South Main Street, Pittsford, on December 20, 2004 and filed in the Town Clerk's office.

Chairman, David Rogachefsky, called the regularly scheduled meeting of the Zoning Board of Appeals to order at approximately 7:00 p.m.
Richard Williams, attorney to the board, read the Legal Notices as published in the November 3, 2004, Wednesday edition of the Brighton Pittsford Post for the following properties:
PUBLIC HEARING
9 Charmwood Road,
Tax #151.12-1-33
Requesting relief from Code Sections 185-15 C (1),
requiring a 70' front setback.
Zoned AA Residential
Richard Sutera owner of 9 Charmwood Road presented the application as submitted. The reason they would like to build this covered front porch it to protect visitors from inclement weather. The porch would be 6' wide and 18' long and it would come out even with the garage.
The board comments:
- What about the windows that are covered with plywood?
- Construction time?
Mr. Sutera commented that they are waiting for the new windows to be installed and should be in around the 22 of December. The sooner the better to get started they will probably wait until spring for the footers to be dug for the covered front porch.
There were no public comments and no additional comments from the board members.
This is a local matter. A Type II Action therefore is not subject to a SEQRA review.
George Dounce moved to close the Public Hearing.

RESOLUTION:

Discussion:
The board members commented that the addition of this proposed covered front porch would enhance the property and also cover visitors from inclement weather.Robert Shaddock moved to grant to the owners of 9 Charmwood Road the requested area variance to construct a new covered front porch within the 70' front setback.
Seconded: George Dounce
Roll Call: All AyesA resolution was passed granting the requested area variance to construct a new covered front porch within the 70' front setback allowing a 47.3 foot' front setback at the above-mentioned property. Completion date December 31, 2006.
