Proceedings of a regular meeting of the Pittsford Town Board held on Tuesday, February 24, 2004 at 7:00 P.M. local time in Pittsford Town Hall.

PRESENT
Supervisor Carpenter; Councilpersons Sandra F. Zutes, John J. Higgins, Jr., Karen W. Green, and John E. Bernacki, Jr.

ABSENT
None

ALSO PRESENT
Staff Members: Jared C. Lusk, Town Attorney; Michael J. Garland, P.E., Commissioner of Public Works; Gregory J. Duane, Finance Director; and, Patricia E. Chuhta, Town Clerk.

ATTENDANCE
Nine members of the public were in attendance.

Supervisor Carpenter called the meeting to order at 7:00 P.M. and invited everyone to stand for the Pledge of Allegiance.


PUBLIC COMMENTS
There were no public comments.

SUPERVISOR'S COMMENTS
Supervisor Carpenter said that he has received an outpouring of resumes for the open positions on the Town Advisory Boards and has been conducting interviews. Supervisor Carpenter further indicated that he hopes to make recommendations to fill the open Volunteer positions at the next Town Board meeting except for the Youth Volunteer positions. He hopes to receive recommendations for these positions from the Pittsford School District soon.

MINUTES OF FEBRUARY 3, 2004 APPROVED
The following Resolution was offered by Councilwoman Green, seconded by Councilwoman Zutes,
RESOLVED, that the minutes of the February 3, 2004 Town Board meeting are approved as written.
ROLL CALL VOTE: Ayes, Zutes, Higgins, Green, Bernacki and Carpenter. Nays, none. Declared carried.

VOUCHERS FOR FEBRUARY, 2004 APPROVED
The following Resolution was offered by Councilman Higgins, seconded by Councilman Bernacki,
RESOLVED, that February 2004 vouchers No. 59858 through No. 60270 in the amount of $2,233,977.32 are approved for payment.
ROLL CALL VOTE: Ayes, Zutes, Higgins, Green, Bernacki and Carpenter. Nays, none. Declared carried.

2004 JANES LIBRARY PETTY CASH FUND AMENDED
The following Resolution was offered by Councilman Higgins, seconded by Councilman Bernacki,
RESOLVED, that the Janes Library Petty Cash Fund is increased by $20.00 to a total amount of $100.00 for fiscal year 2004. It is
FURTHER RESOLVED, that Ichin Zinn is named custodian for this Petty Cash account.
ROLL CALL VOTE: Ayes, Zutes, Higgins, Green, Bernacki and Carpenter. Nays, none. Declared carried.

FLEET CAPITAL ACCOUNT APPROPRIATIONS APPROVED
The following Resolution was offered by Councilwoman Green, seconded by Councilwoman Zutes,
RESOLVED, that $49,500.00 be appropriated from the Highway Equipment Capital Reserve for scheduled equipment replacement. It is
FURTHER RESOLVED that this Resolution is subject to Permissive Referendum and that the Director of Finance is authorized to make the appropriate budget entries.
ROLL CALL VOTE: Ayes, Zutes, Higgins, Green, Bernacki and Carpenter. Nays, none. Declared carried.

SEQR FOR CDBG GRANT APPLICATION APPROVED
The following Resolution was offered by Supervisor Carpenter, seconded by Councilman Higgins,
RESOLVED, that the Pittsford Town Board, upon consideration of the Short Form Environmental Assessment Form, and the Town Board having taken a "hard look" at potential adverse environmental impacts of the proposal, and having given this matter due deliberation and consideration, finds that Phase III of King's Bend Park will not have a significant adverse impact on the environment; and, it is
FURTHER RESOLVED, that the Town Board issues a Negative Declaration for the project.
ROLL CALL VOTE: Ayes, Zutes, Higgins, Green, Bernacki and Carpenter. Nays, none. Declared carried.

CDBG GRANT APPLICATION AUTHORIZED
The following Resolution was offered by Councilman Bernacki, seconded by Councilwoman Zutes,
RESOLVED, that the Supervisor is authorized to apply to Monroe County for a Community Development Block Grant for the construction of a bridge at King's Bend Park.
ROLL CALL VOTE: Ayes, Zutes, Higgins, Green, Bernacki and Carpenter. Nays, none. Declared carried.

DISCUSSION: SEWER FEASIBILITY SOUTH OF THE NYS THRUWAY
Supervisor Carpenter discussed the south of the New York State Thruway area, the informational meetings that had been held with residents to help identify development criteria for approximately 258 acres of land. He shared the plan created by Behan Associates based on the recommendations that came out of the informational meetings.
Supervisor Carpenter noted that a new zoning district is being proposed for this area, Rural Residential South Pittsford ("RRSP"). He discussed the proposed new zoning district; the Draft Updated Comprehensive Plan; and, any public hearings that would be necessary to move forward. In addition, the Supervisor answered questions from the Town Board and members of the audience before introducing Commissioner of Public Works, Mike Garland.
Commissioner of Public Works Garland discussed the results of the Sewer Feasibility Study that was conducted by the Town Engineer, MRB Group. He noted that the study was based on the recommendations and findings of Behan Associates as they created the updated Comprehensive Plan.
Commissioner Garland also discussed the current sewer facilities north of the New York State Thruway on Clover Street, excess capacity issues, and the engineer's findings that it is feasible to extend sewers south of the New York State Thruway. This discussion included the possible sewer route to extend the existing trunk sewer, the need for excess capacity in this area for future development needs, and estimated sewer costs. He answered Reeves Road residents' questions regarding the proposed sewer route, sewer extension costs and sewer extension procedures.
Supervisor Carpenter thanked the residents for their help and input. He also extended his thanks to Chuck Ryan for his help and patience during the Comprehensive Plan update process.

PUBLIC HEARING SET: PROPOSED UPDATE TO THE TOWN'S COMPREHENSIVE PLAN
The following Resolution was offered by Supervisor Carpenter, seconded by Councilwoman Green,
RESOLVED, that a public hearing be held on the 16th day of March, 2004, at 7:00 P.M., Local Time, at the Town Hall, 11 South Main Street, Pittsford, New York, on the question of whether to adopt the proposed update to the Town's Comprehensive Plan affecting the real property located within the Town of Pittsford south of the New York State Thruway; and it was further
RESOLVED, that a Notice of Hearing, or a summary thereof, be published in a newspaper previously designated as an official newspaper for publication of public notices, not less than five (5) days prior to said hearing; and be it further
RESOLVED, that the Town Clerk shall post a certified copy of this resolution on the bulletin board maintained by the Town Clerk pursuant to § 30(6) of the Town Law, and make available said Draft Update to the Comprehensive Plan, or a summary thereof, for review, for a period of not less than five (5) days prior to said public hearing.
ROLL CALL VOTE: Ayes, Zutes, Higgins, Green, Bernacki and Carpenter. Nays, none. Declared carried.

PUBLIC HEARING SET: PROPOSED LOCAL LAW 2 OF 2004: CREATION OF RURAL RESIDENTIAL SOUTH PITTSFORD ZONING DISTRICT
The following Resolution was offered by Councilwoman Zutes, seconded by Councilman Bernacki,
RESOLVED, that a public hearing be held on the 16th day of March, 2004, at 7:00 P.M., Local Time, at the Town Hall, 11 South Main Street, Pittsford, New York, on the question of the adoption of proposed Local Law No. 2 of 2004: Creation of Rural Residential South Pittsford Zoning District, or a summary thereof, be published in a newspaper previously designated as an official newspaper for publication of public notices, not less than five (5) days prior to said hearing; and be it further
RESOLVED, that the Town Clerk shall post certified copies of both this resolution and said proposed Local Law No. 2 of 2004: Creation of Rural Residential South Pittsford Zoning District, or a summary thereof, on the bulletin board, maintained by the Town Clerk pursuant to § 30(6) of the Town Law, for a period of not less than five (5) days prior to said public hearing.
ROLL CALL VOTE: Ayes, Zutes, Higgins, Green, Bernacki and Carpenter. Nays, none. Declared carried.

PUBLIC HEARING SET: PROPOSED RE-ZONING OF CERTAIN REAL PROPERTY SOUTH OF THE NEW YORK STATE THRUWAY
The following Resolution was offered by Councilman Bernacki, seconded by Councilwoman Zutes,
RESOLVED, that a public hearing be held on the 2nd day of March, 2004, at 7:00 P.M., Local Time, at the Town Hall, 11 South Main Street, Pittsford, New York, on the question of whether to re-zone the real property described in Exhibit "A" from the "RRAA" District to the Rural Residential South Pittsford ("RRSP") District; and be it further
RESOLVED, that a Notice of Hearing, or a summary thereof, be published in a newspaper previously designated as an official newspaper for publication of public notices, not less than five (5) days prior to said hearing; and be it further
RESOLVED, that the Town Clerk shall post a certified copy of this resolution on the bulletin board maintained by the Town Clerk pursuant to § 30(6) of the Town Law, and make available proposed Local Law 2 of 2004 creating the Rural Residential South Pittsford Zoning District and the draft Update to the Town Comprehensive Plan, or summaries thereof, for review, for a period of not less than five (5) days prior to said public hearing.
ROLL CALL VOTE: Ayes, Zutes, Higgins, Green, Bernacki and Carpenter. Nays, none. Declared carried.

CONTRACT WITH MARIO'S VIA ABRUZZI FOR 2004 TOWN WIDE MEETING AUTHORIZED
The following Resolution was offered by Councilwoman Zutes, seconded by Councilman Higgins,
RESOLVED, that the Town Board authorizes the Supervisor to sign a contract with Mario's Via Abruzzi for use of their facility for the 2004 Townwide meeting in the amount of $2,300.00.
ROLL CALL VOTE: Ayes, Zutes, Higgins, Green, Bernacki and Carpenter. Nays, none. Declared carried.

SEMINAR ATTENDANCE AUTHORIZED
The following Resolution was offered by Supervisor Carpenter, seconded by Councilwoman Green,
RESOLVED, that the following individuals are approved for conference attendance:

  • Parks employees Marie Drury and Doug McVay to the NYS DEC Pesticide Seminar in Rochester on March 18, 2004 at a cost of $15.00 each.
  • Town Clerk Patricia Chuhta to the annual NYS Town Clerk's Association Seminar in Saratoga Springs, April 18 to 24, at a cost of $584.00.
  • Environmental Board member Harmon Strong to the Cornell Cooperative Extension Land Use and Community Development Seminar Series in Rochester at a cost of $40.00.

 ROLL CALL VOTE: Ayes, Zutes, Higgins, Green, Bernacki and Carpenter. Nays, none. Declared carried.

EXECUTIVE SESSION CALLED
The following Resolution was offered by Supervisor Carpenter, seconded by Councilwoman Zutes,
RESOLVED, that the Town Board will go into executive session to discuss a potential property acquisition issue.
ROLL CALL VOTE: Ayes, Zutes, Higgins, Green, Bernacki and Carpenter. Nays, none. Declared carried.

As there was no further business, the Supervisor adjourned the meeting at 8:17 P.M.

RETURN TO REGULAR SESSION
The following Resolution was offered by Supervisor Carpenter, seconded by Councilwoman Green,
RESOLVED, that the Town Board will return to regular session.
ROLL CALL: Ayes, Zutes, Higgins, Green, Bernacki and Carpenter. Nays, none. Declared carried.

PURCHASE OF REAL PROPERTY AUTHORIZED
The following Resolution was offered by Supervisor Carpenter, seconded by Councilwoman Zutes,
RESOLVED, that pursuant to Town Law §§64(2) and 220 the Town Supervisor is authorized to enter into a contract to purchase real property, said property described in Exhibit "A" and in an amount not to exceed that set forth in Exhibit "A"; and, be it
FURTHER RESOLVED, that Exhibit "A" shall be deemed confidential until the contract to purchase the property described therein has been executed by all parties and is final and binding on all parties. (See Attachment A.)
