Proceedings of a regular meeting of the Pittsford Town Board held on Tuesday, February 6 2007 at 7:00 P.M. local time in Pittsford Town Hall.

PRESENT
Supervisor William A. Carpenter and Councilpersons Sandra F. Zutes, John J. Higgins, Jr., Karen W. Green, and John E. Bernacki, Jr.
ABSENT
There were no Town Board members absent.
ALSO PRESENT
Staff Members: Paul J. Schenkel, Commissioner of Public Works; Gregory J. Duane, Finance Director; Paul W. Wilson, Director of Recreation & Technology; Flo Dorsey, Recreation Supervisor; Richard T. Williams II, Town Attorney; Patricia E. Chuhta, Town Clerk.
ATTENDANCE
Three members of the public were in attendance.

Supervisor Carpenter called the meeting to order at 7:00 P.M. and invited everyone to stand for the Pledge of Allegiance.

PUBLIC COMMENTS
There were no public comments.

 PUBLIC HEARING: PROPOSED ESTABLISHMENT OF THE MENDON CENTER ROAD WATER DISTRICT 1
The residents in the proposed water district have requested a two-week extension to complete looking into their options on this issue; therefore, this item continues to be tabled.

SUPERVISOR'S COMMENTS

  • Supervisor Carpenter indicated that the Leadership Team would be meeting later this month to begin working on the concept of "One Community". Supervisor Carpenter requested that Town Board members bring their ideas regarding this concept to the meeting.
  • Supervisor Carpenter briefly discussed the proposed changes to the STAR exemptions. He indicated that he would be contacting our local state representatives to encourage them to keep income verification at the state level.

MINUTES OF JANUARY 16 2007 APPROVED
The following Resolution was offered by Councilman Bernacki, and seconded by Councilwoman Green,
RESOLVED, that the minutes of January 16 2007 Town Board meeting are approved as written.
ROLL CALL VOTE: Ayes: Zutes, Higgins, Green, Bernacki and Carpenter. Nays: none. Declared carried.

RESOLUTION OF COMMENDATION: VIN NOLAN - BRIGHTON FIRE DEPARTMENT
The following Resolution was offered by Supervisor Carpenter, and seconded by Councilman Bernacki,
RESOLVED, that the Pittsford Town Board of the Town of Pittsford express their congratulations and gratitude to Vin Nolan for his faithful and dedicated service to his community.
ROLL CALL VOTE: Ayes: Zutes, Higgins, Green, Bernacki and Carpenter. Nays: none. Declared carried.

PUBLIC HEARING SET: PROPOSED LOCAL LAW 1 OF 2007 - AMENDING ARTICLE I OF CHAPTER 133 OF THE TOWN OF PITTSFORD MUNICIPAL CODE ENTITLED TAXATION (SENIOR CITIZEN TAX EXEMPTION)
The following Resolution was offered by Councilwoman Zutes, and seconded by Councilman Higgins,
RESOLVED, that a public hearing be held on the 20th day of February, 2007, at 7:00 P.M., Local Time, at the Town Hall, 11 South Main Street, Pittsford, New York, on the question of the adoption of said proposed Local Law No. 1 of 2007; and be it further
RESOLVED, that a Notice of Hearing and a copy of said proposed Local Law 1 of 2007, or a summary thereof, be published in a newspaper previously designated as an official newspaper for publication of public notices, not less than five (5) days prior to said hearing; and be it further
RESOLVED, that the Town Clerk shall post certified copies of both this resolution and said proposed Local Law No. 1 of 2007, or a summary thereof, on the bulletin board, maintained by the Town Clerk pursuant to § 40(6) of the Town Law, for a period of not less than five (5) days prior to said public hearing.
ROLL CALL VOTE: Ayes: Zutes, Higgins, Green, Bernacki and Carpenter. Nays: none. Declared carried.

PUBLIC HEARING SET: PROPOSED LOCAL LAW 2 OF 2007 - AMENDING ARTICLE VII OF CHAPTER 133 OF THE TOWN OF PITTSFORD MUNICIPAL CODE ENTITLED TAXATION (DISABLED CITIZEN TAX EXEMPTION)
The following Resolution was offered by Councilwoman Zutes, and seconded by Councilwoman Green,
RESOLVED, that a public hearing be held on the 20th day of February, 2007, at 7:00 P.M., Local Time, at the Town Hall, 11 South Main Street, Pittsford, New York, on the question of the adoption of said proposed Local Law No. 2 of 2007; and be it further

DISCUSSION: REVIEW OF 2007 COMMUNITY EVENTS SCHEDULE
Recreation Supervisor Flo Dorsey reviewed the proposed 2007 Community Events Schedule with the members of the Town Board.

PUBLIC HEARING SET: PROPOSED GREYTHORNE HILL SUBDIVISION PARK DISTRICT
The following Resolution was offered by Councilman Bernacki, and seconded by Councilman Higgins,
RESOLVED AND ORDERED, that a public hearing be held before the Town Board of the Town of Pittsford, at the Town of Pittsford Town Hall, on the 6th day of March 2007 at 7:00 o'clock P.M., Local Time, to consider the said Petition and to hear all persons interested therein, and for such other and further action on the part of the Town Board with relation to the said Petition as may be required by law or proper in the premises; and it is further
RESOLVED AND ORDERED, that a copy of the within Resolution be duly published in the Brighton-Pittsford Post which paper is designated as the official paper for such publication, and a copy of the said Resolution be posted on the bulletin board of the Town Clerk of the Town of Pittsford, New York, maintained pursuant to Section 30 of the Town Law, not less than ten (10) nor more than twenty (20) days prior to the date of the said hearing.
ROLL CALL VOTE: Ayes: Zutes, Higgins, Green, Bernacki and Carpenter. Nays: none. Declared carried.

PUBLIC HEARING SET: PROPOSED EXTENSION 8 TO THE 1-2 POLE LIGHTING DISTRICT FOR GREYTHORNE HILL SUBDIVISION
The following Resolution was offered by Councilman Higgins, and seconded by Councilwoman Zutes,
RESOLVED AND ORDERED, that a public hearing be held before the Town Board of the Town of Pittsford, at the Town of Pittsford Town Hall, on the 6th day of March 2007 at 7:00 o'clock P.M., Local Time, to consider the said Petition and to hear all persons interested therein, and for such other and further action on the part of the Town Board with relation to the said Petition as may be required by law or proper in the premises; and it is further
RESOLVED AND ORDERED, that a copy of the within Resolution be duly published in the Brighton-Pittsford Post which paper is designated as the official paper for such publication, and a copy of the said Resolution be posted on the bulletin board of the Town Clerk of the Town of Pittsford, New York, maintained pursuant to Section 30 of the Town Law, not less than ten (10) nor more than twenty (20) days prior to the date of the said hearing.

HIGHWAY ROAD DEDICATION ACCEPTED - GREYTHORNE HILL
The following Resolution was offered by Councilwoman Zutes, and seconded by Councilman Bernacki,
RESOLVED, that the Town Board does hereby consent that a public highway, to be known as "Greythorne Hill" (.49 miles), in the Town of Pittsford, Monroe County, New York be laid out in said Town of Pittsford, more particularly described as set forth on Schedule "A" annexed hereto, and the Town Superintendent of Highways is authorized to make an order laying out the lands described in said dedication; and it is further
RESOLVED, that the Town Board does hereby consent that the lands comprising the aforesaid public highway be accepted in dedication as per Attachment A.

BID OPENING DATE SET:
The following Resolution was offered by Councilman Bernacki, and seconded by Councilwoman Green,
RESOLVED, that the Town Board sets a bid opening date of Monday, February 26 2007 at 11:00 A.M. in the Department of Public Works for the 2007 Grounds Maintenance contract.
ROLL CALL VOTE: Ayes: Zutes, Higgins, Green, Bernacki and Carpenter. Nays: none. Declared carried.

MONROE COUNTY EMPIRE ZONE REGIONALLY SIGNIFICANT PROJECT APPLICATION
An application for the Monroe County Empire Zone Regionally Significant Project has been withdrawn for Town Board consideration at a later date. $6,000

COMMUNITY DEVELOPMENT BLOCK (CDBG) GRANT CONTRACT FOR ADA IMPROVEMENTS AT THE VAN HUYSEN SENIOR CENTER AUTHORIZED
The following Resolution was offered by Councilwoman Green, and seconded by Councilwoman Zutes,
RESOLVED, that the Town of Pittsford accepts a Community Development Block Grant in the amount of $6,000.00 to be used at the Van Huysen Senior Center. It is
FURTHER RESOLVED, that the Supervisor is authorized to sign a contract with Monroe County Department of Planning for these funds.

SEWER DEPARMENT COPIER MAINTENANCE AGREEMENT AUTHORIZED
The following Resolution was offered by Councilman Higgins, and seconded by Councilwoman Green,
RESOLVED, that the Town Board accepts the recommendation of the Commissioner of Public Works and authorizes the Supervisor to sign a one-year contract agreement for the Sewer Department copier with Eagle Systems Inc. in the amount of $384.00.
ROLL CALL VOTE: Ayes: Zutes, Higgins, Green, Bernacki and Carpenter. Nays: none. Declared carried.

SEMINAR ATTENDANCE AUTHORIZED
The following Resolution was offered by Supervisor Carpenter, and seconded by Councilman Bernacki,
RESOLVED, that the following individuals are approved to attend the following seminar and/or conference:

  • Technology Specialist Joy Brown to the Rochester Conference on Emergency Response Planning in Rochester on February 27 2007 at a cost of $199.00,
  • Deputy Commissioner of Public Works Ed Starowicz to the PERMA Safety Coordinator Certificate Training in Amherst on March 17 2007 at no cost.

ROLL CALL VOTE: Ayes: Zutes, Higgins, Green, Bernacki and Carpenter. Nays: none. Declared carried.

DISCUSSION: ANNUAL PROCUREMENT POLICY REVIEW
The Town Board performed the annual review of the Town Procurement Policy. The conclusion of this review was that no changes or actions are required at this time. (See Attachment B.)

As there was no further business, the Supervisor adjourned the meeting at 7:36 P.M.
