Proceedings of a regular meeting of the Pittsford Town Board held on Thursday, January 3, 2008 at 7:00 P.M. local time in Pittsford Town Hall.
PRESENT
Supervisor Carpenter; Councilpersons Sandra F. Zutes, John J. Higgins, Jr., Karen W. Green, and John E. Bernacki, Jr.
ABSENT
No Town Board member was absent.
ALSO PRESENT
Staff Members: Paul Schenkel, Commissioner of Public Works; Gregory J. Duane, Finance Director; Julie House, Personnel Director; Patricia E. Chuhta, Town Clerk.
ATTENDANCE
Four members of the public were in attendance.
Supervisor Carpenter called the Town Board meeting to order at 7:00 P.M. and invited everyone to stand for the Pledge of Allegiance.
SUPERVISOR'S APPOINTMENTS FOR 2008
Supervisor Carpenter announced the following appointments for 2008:
- Deputy Supervisor - Sandra F. Zutes
- Director of Finance and Budget Director - Gregory Duane
- Secretary to the Supervisor - Linda Dillon
- Town Historian - Audrey Johnson
TOWN BOARD LIAISONS FOR 2008
Supervisor Carpenter announced Town Board liaison assignments for 2008:
- Supervisor Carpenter - Leadership Committee
- Councilwoman Zutes - Leadership Committee, Group Homes, Environmental Board
- Councilman Higgins - Parks and Recreation Board, Pittsford Youth Services, SCPC
- Councilwoman Green - Planning Board, Historic Preservation Commission

STAFF APPOINTMENTS FOR 2008-2009

HISTORIC PRESERVATION COMMISSION CHAIR, VICE-CHAIR APPOINTMENTS FOR 2008
The following Resolution was offered by Councilwoman Green seconded by Supervisor Carpenter,
RESOLVED, that John Mitchell is re-appointed Historic Preservation Commission Chair and Paul Whitbeck is re-appointed Historic Preservation Vice-Chair for 2008.

PARKS AND RECREATION BOARD APPOINTED FOR 2008
The following Resolution was offered by Councilman Bernacki, seconded by Councilman Higgins,
RESOLVED, that the following persons are appointed to serve on the Parks and Recreation Board for 2008: Leonard Freedman, Mary Ellen Spennacchio-Wagner, Cupertino Anaya, Rick Taylor, Julie Doyle and Taylor Rubiano.

RESOLVED, that Jeffrey House is re-appointed Planning Board Chair and Rhett Smith is re-appointed Vice Chair for 2008.

ZONING BOARD OF APPEALS RE-APPOINTMENT

RESOLVED, that the MRB Group, PC is appointed Town Engineer for 2008.

TOWN ATTORNEY APPOINTED FOR 2008

RESOLVED, that Richard T. Williams is appointed Town Attorney for 2008.

2008 SALARIES APPROVED

SEQRA DETERMINATION: SPRING HOUSE COMMONS RE-ZONING APPLICATION

RESOLVED, the Pittsford Town Board, upon consideration of all written and oral submissions by the Applicant, appropriate agencies and public comment, and following due deliberation and consideration, finds that the proposed re-zoning will have no significant adverse impact on the environment; and, accordingly, issues a Negative Declaration for the proposed re-zoning of a portion of the real property commonly known as "Spring House Commons North", as aforesaid.

SPRING HOUSE COMMONS NORTH RE-ZONING APPLICATION APPROVED
The following Resolution was offered by Councilwoman Zutes, seconded by Councilwoman Green,
RESOLVED, that the proposed re-zoning of the aforesaid parcels of real property, totaling approximately 1.3 acres in size, and as such parcels are more particularly described in Exhibit "A", attached hereto, is hereby approved, thereby amending and changing the zoning of said parcels from "A Residential" to "Commercial"; and be it
FURTHER RESOLVED, that the Official Zoning Map of the Town of Pittsford be amended to reflect this re-zoning; and be it
FURTHER RESOLVED, that the within re-zoning is subject to the following conditions:
- The buildings and parking shall not exceed the amounts reflected on the plan entitled "Spring House Commons North - Exhibit 2", Project No. 053008, prepared by Fisher Associates, and dated October 23, 2007. No additional buildings, expansions, parking areas or driveways shall be added to any of the buildings and/or parking areas shown on the applicant's plans.
- The architectural features of all sides of all buildings shall be reasonably consistent with one another and shall take into consideration the visual impact on adjoining properties. Details associated with architectural features are to be approved by the Architectural Review Board, as part of the site plan approval process, in accordance with the above condition.
- Significant vegetative buffering shall be established to mitigate the visual impact of the development on residential properties. Such buffering may be on the development parcel and/or on adjoining residential parcels. Details associated with such buffering are to be approved by the Planning Board, as part of the site plan approval process, in accordance with the above condition.
- During periods of construction a screening fence shall be installed and maintained, in the location of the existing fence, and so as to provide a visual buffer for adjoining residential properties. Details associated with such screening fence are to be approved by the Planning Board, as part of the site plan approval process, in accordance with the above condition.
- This Board finds that the plans submitted by the applicant demonstrate reasonable compliance with the Town's requirements, as set forth in the Memorandum from DPW Commissioner Paul Schenkel and Town Engineer Robert Fromberger, dated February 2, 2006, for a walking trail located on the former Auburn Rail right-of-way along the northern property boundary of the parcels. Specific trail plans and provisions are to be approved by the Planning Board, as part of the site plan approval process, in accordance with the above condition.
- In accordance with the attached map, an easement will be established across the entire perimeter of the rear portion of the properties to be rezoned. The width of the easement will be determined as follows:
- Along the northerly end of the parking lot for Building #1
- 60 feet in width between the easterly end of the parking lot for Building #1 and the westerly end of the parking lot for Buildings #2, #3 & #4
- Along the entire northerly edge of improvements from the westerly end of the parking lot for Buildings #2, #3 & #4 to the easterly end of Building #5
- The entire area encompassed between the easterly end of Building #5 and the easterly property line.
- The easement will allow for trail improvements, drainage improvements, storage of snow, vegetative and non-vegetative buffers and emergency access.

Intending to describe a portion of the land now or formerly owned by Monroe Clover Plaza, LLC, as recorded in Liber 9356 of deeds page 440 and having S.B.L. 150.08-1-64.1, containing 0.44 acre more or less.

GRANT WRITING AGREEMENT WITH STUART I BROWN ASSOCIATES INC. AUTHORIZED
The following Resolution was offered by Councilman Bernacki, seconded by Councilwoman Zutes,
RESOLVED, that the Town Board authorizes an agreement with Stuart I Brown Associates Inc to prepare an application for funding under the Records Management Program administered by the State Archives at a cost of one thousand five hundred dollars ($1,500.00) pending approval by the Town Attorney.
ROLL CALL: Ayes: Zutes, Higgins, Green, Bernacki and Carpenter. Nays: none. Resolution declared carried.
SEMINAR ATTENDANCE AUTHORIZED
The following Resolution was offered by Councilwoman Green, and seconded by Councilwoman Zutes,
RESOLVED, that the following individual be approved for attendance at the following seminar:
- Supervisor William Carpenter to the Association of Towns annual conference in New York City on February 17 to 20, 2008 at a cost of $900.00.
