Minutes of the Planning Board Meeting held in the Town Hall basement meeting room, 11 South Main Street, Pittsford, on January 27, 2003, and filed in the Town Clerk's Office

Bill Brizee called the meeting to order at 7:38 p.m., and welcomed Boy Scout Troop 341.

Karl Essler of Fix Spindleman and Mike Braun of Fisher Associates were present to represent the applicant. Nancy Sprenkle indicated a resolution was prepared and the Board had reviewed it. Nancy made a motion to accept the resolution as written, Bill Brizee seconded the motion and the Board voted unanimously to grant approval. A copy of the resolution is attached.

Bill Brizee asked Don Lasher of Buckingham Properties to prepare a rendering of Building 5 as it relates to Wink Photo and the Bird House structure including the existing trees and representations of figures. Bill asked Don to remain for further discussion at the end of the hearing.

Martin Janda of BME represented the applicant. Bill Brizee indicated the Board had concerns regarding the sequence of landscaping and parking expansion. Marty Brewster noted it would be appropriate to have the buffering in place and allow it to mature prior to plans to expand parking. Marty questions whether landscaping should also be considered on east side of Marsh Road adjacent to an existing berm.

Marty indicated the architect needs to respond to the issue of fire protection relating to the new NYS uniform building code. Bill Brizee questioned whether the architect would respond to the sprinklers and fire hydrant issue. In addition, Bill would like a definition of use for the addition/property.

Pastor Goodnough will provide a clarification of use for the addition and in regard to the sprinklers code he is sure the architects would meet code.

Bill would like a checklist created to identify outstanding items. Cary Smith is point and she will arrange the checklist.

Bill LaForte introduced himself, Chuck Ryan, president and Bryan Powers of Sear Brown and Dan Mossien, architect.

Bill Brizee removed himself from this hearing.

Bill LaForte indicated site selection was a cooperative effort and noted Mr. Carpenter suggested a two building concept plan. Mr. LaForte indicated would not work.

Bryan Powers explained a number of options were considered, meetings held and discussions have taken place with a variety of Board members, staff and residents to ensure preservation of the architectural integrity along with the residential character.

The main issues include building size and access from Tobey Village Rd. across parcel 8.

In Option 1 - the 7400 sq. foot building with 29 parking spaces locating entire parking area in Parcel 12 causing the building to be placed closer to the existing home to the north set 20 feet from property line limiting landscaping. Also, narrowed space between parking and building from 27' to 15' edge of building to parking and the last difference is a reduction of drive isle width from 24' wide to 20' which is still within the Town's tolerance.

Option 2 - is 7400 sq. ft. building becomes two 3700 sq. ft. buildings separated by 30' as per code - if the area is narrowed a better fire wall is required and window openings would have to be minimized. Because this is an office building and while trying to preserve the residential quality this is not a good choice. Parking remains the same number however 5 spaces would be in the lower area.

The last option (2A) would also be two 2-story buildings 3700 sq.ft. each moving one north building to within 20' of property line however now south building is partially in adjacent parcel.

Discussion continued regarding access points and boundaries.

A meeting will be arranged next week with Chuck, David Jefferson, Marty, Doug, Brian and Dan to work through the process.

AUTUMN WOODS - Section 3

The applicant was not present.

Marty will be meeting with John Stapleton to review draft DRC response important decisions to be made involve road stub to Ellsworth property, possibly some Ag buffering questions and grading. Bill will defer additional conversation to when applicant is present.

ST. JOHN FISHER College

Bob Burgdorf of Nixon Peabody explained the expansion would allow for 84 additional beds to alleviate off campus housing. There would be no change to the building's footprint and the college held a neighborhood meeting. The DRC response sent. Mr. Burgdorf presented photos indicating dorm location and indicated no additional parking is planned.

Bill Brizee mentioned concerns regarding potential noise and lighting impacts on neighbors. Mr. Burgdorf indicated lighting should not change and should be minimal because the dorm is air-conditioned and windows would not be open.

Nancy Sprenkle pointed out an area labeled 490 is incorrect on the new master plan for the college.

Marty Brewster questioned parking modifications and Mr. Burgdorf explained restriping is planned not additional parking. There was no public comment and the hearing was closed.

APPLEBEE'S RESTAURANT

Mr. Brizee indicated receipt of DRC response. Al Friedrich of Wilmorite indicated he is awaiting a response from Applebee's regarding ARB comments.

Nancy Sprenkle inquired about the ARB comments. Mr. Friedrich explained the ARB asked for continuance of the existing canopy to improve the face of the building as well as screening of ventilation systems. Nancy mentioned the location of the front door could create an unsafe crossing area for pedestrians and possibly a stop sign incorporated into the parking area. Mrs. Sprenkle asked what the hours of operation would be and phone orders would be taken and pick up planned. Mr. Friedrich is not aware of any pick up window plans.

Mrs. Sprenkle addressed the use of an ionized filtration system to eliminate odors and noted the DRC response indicated the restaurant is 400 feet from neighbors and would not impact neighbors however it could be utilized if found necessary. Marty Brewster indicated written comments are forthcoming from ARB. There was no public comment and Bill Brizee closed hearing

DISCUSSION/WORKSHOP

Spring House discussion covered the following a 15' buffer, viewshed, 7' trail could meander, parking ratio about 75% of that required, building size (height concerns) pedestrian crossing safety issues and drainage requirements.

Bill Brizee mentioned the possibility of a draft resolution for buildings1-4 or the south side at this time and the north side at a later date. Marty Brewster indicated the archeological investigation should move forward.

Nancy requested member review the draft resolution and contact her.

The Highlands intends to maintain a neighborhood flavor with sidewalks, gardens and lighting and construct 36 residential homes. There is concern regarding roadway access.

Autumn Woods Subdivision - concern exists regarding home density on steep grades and access
