Minutes of the Planning Board Meeting held in the Town Hall basement meeting room, 11 South Main Street, Pittsford, on January 24, 2005, and filed in the Town Clerk's office

PRESENT
Bill Brizee, Jeff House, Jeff Carone, David Wigg, and Larry Magguilli

ABSENT
Dave Jefferson, Cary Smith, and Linda Dzakowic, Planning Secretary

ALSO PRESENT
Rich Williams II, Planning Board Attorney, Martin Brewster, Director of Planning, Zoning & Development, Doug DeRue, Planning Assistant, and John Higgins, Town Board

Bill Brizee called the meeting to order at 7:31 p.m. Bill Brizee re-ordered the agenda items to bring applications that had decisions prepared for them to the front of the agenda.

PUBLIC HEARING CONTINUED:

NEW RESTAURANT Special Permit 3349 Monroe Avenue
Tax Parcel #150.12-1-18

Charlie Fitzsimmons indicated that he had submitted the additional information that the Board had requested and offered to answer any additional questions that the Board may have. Charlie indicated they had not decided on a name for the restaurant.

Bill Brizee replied that he had no additional questions and was satisfied with Charlie's responses to the DRC questions. Bill Brizee indicated the hearing was still open and asked if there was any additional public comment, there was none and Bill closed the Public Hearing.

Bill asked the Board members if they had any additional questions being none Bill moved a resolution granting a Negative Declaration regarding SEQRA and Jeff House seconded the resolution and the Board voted to approve the resolution.

Bill then moved a resolution granting Special Permit approval for the Restaurant and Jeff Carone seconded the resolution the Board voted to approve the resolution. Resolutions are attached.

SPRING HOUSE RESTAURANT Site Plan Special Permit 3001 Monroe Avenue,

Don Lasher of Buckingham Properties asked the Board if they had any questions regarding his response to the DRC report.

The Board had no additional questions and Bill Brizee asked if there were any additional public comments, there were no comments and Bill closed the Hearing.

Bill Brizee moved a resolution granting a Negative Declaration regarding SEQRA and Larry Magguilli seconded the resolution. The Board voted to approve the resolution and Bill moved a resolution granting Site Plan and Special Permit approval for the restaurant. Larry Magguilli seconded the resolution and the Board voted to approve the resolution. Resolutions are attached.

CLOVER PONDS CONCEPT SUBDIVISION (92) Lots
Tax Parcel #191.01-0001-018 & 019

Mr. Ryan, the applicant was present and offered no additional information at this time.

Bill Brizee updated the Board and the public in regards to where the process is and explained that the Board is awaiting a review letter from Behan Planning. The Town staff, the Board and the advisory Boards are reviewing the DRC response.

Bill asked if there was any public comment and none was offered. The hearing remains open.

ALDRIDGE CONCEPT SUBDIVISION (32 lots on 48 acres)
Tax Parcel #163.03-1-65

Bill Brizee explained that the Part III EAF was distributed to the Board, advisory Boards, the Town of Henrietta, the Town Engineer and there were copies available for public review.
Peter Vars of BME Associates offered to answer any questions that the Board had (they had no questions at this time)

Bill Brizee asked for comments on the EAF III and specifically the alternate layouts be submitted to the Board prior to the February 14th Planning Board meeting. At which time he indicated the hearing may be closed.

Mary Scheuermann of 149 West Brook Road asked some specific questions regarding deed restrictions vs. rural conservation.
Rich Williams explained that the Zoning requires 50% to be rural conservation and if that is in private ownership there is a conservation easement to the Town of Pittsford over the land.

Mary Scheuermann questioned if the impacts to the woods and wetland were being overlooked, She pointed out that the Biologist's report included in the EAF Part III identified the woods and wetland as the valuable assets of the site and the alternate plans appear to impact the woods and wetland more. Mary also asked why the Phase 1-B cultural assessment would not be completed prior to any construction. Mary also questioned who received the AG. Data statement.

Bill Brizee clarified that during the public hearings it was clear that the public concern favored the impacts on the viewshed and the Board had agreed with this position therefore plans have focused on reducing the viewshed impact and the number of rear yards that face Calkins Road.

Mary Menzie of 219 Mendon Center Road feels that the Town had a good plan with the Greenprint but has failed to follow through and has made poor decisions.

Ted Spall 30 Grove Street, responded to Mary Scheuermann comments by pointing out that she herself was more concerned with viewshed impacts and she had asked specific questions related to the size of homes and the visibility from Calkins Road. Ted went on to point out that the Town on more than one occasion had the chance to buy the development rights and failed to do so. He also pointed out that considerable research has been done in regards to transfer of units and that too has not proved successful.

Mary Scheuermann agreed that her first position was protection of the viewshed, she indicated the John Hecklau report had changed her mind.

The hearing remains open.

AUTUMN WOODS SECTION 2 (43 Lots)

Bill Brizee inquired if the Owner or Engineer was present and neither attended the meeting.
Bill indicated that the public hearing was open and asked of there was any public comment and none was offered.

The hearing remains open.

APPROVED
January 10th Planning Board meeting minutes were approved by voice vote.

The hearing was adjourned at 8:07 p.m.
